Terms of Service

These Terms of Service ("Terms") govern your use of the Think Again iOS app and its website (the "Service"). The Service is operated by an individual ("Think Again", "we", "us", or "our"). Please read these Terms carefully. By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. About These Terms

These Terms form a binding agreement between you and Think Again. They work together with our Privacy Policy, which explains how we handle your data. By using the Service you also acknowledge that policy.

2. What Think Again Is

Think Again is a brain-training and screen-time app for iPhone, available from the Apple App Store. Each day it gives you a short set of cognitive games and a calm timer to help you spend time away from your phone, and it lets you compare daily scores with friends. The website only hosts information about the app and these legal pages.

3. Eligibility

You must be at least 18 years old to use the Service. By using Think Again, you confirm that you meet this requirement and that you can enter into a binding agreement.

4. Your Account

To use Think Again you need an account, which you create by signing in with Apple or Google. We do not offer password accounts.

You are responsible for:

• giving accurate information when you set up your account;
• keeping access to your device and sign-in account secure, and not sharing your account;
• all activity that happens under your account; and
• letting us know promptly at admin@tenzle.com if you believe your account has been used without your permission.

5. Acceptable Use

When using Think Again, you agree not to:

• use the Service for any unlawful purpose or in breach of any applicable law;
• try to gain unauthorised access to the Service, other users' accounts, or our systems;
• try to get around the subscription or payment system;
• interfere with, disrupt, or place an unreasonable load on the Service;
• copy, scrape, reverse-engineer, or try to extract the source code of the Service, except to the extent the law permits;
• submit false scores or otherwise manipulate the scores your friends see;
• choose a display name that is offensive, hateful, sexually explicit, or that impersonates another person; or
• use the Friends feature to harass other users, including by sending repeated unwanted friend requests.

We may remove a display name, or suspend or terminate access, if you break these rules.

6. Your Content

The content you create in Think Again is the display name you choose on the Friends screen. You own it. To run the Service, you give us a limited licence to store it and to show it to other users who search for it and to your friends, next to your scores. We do not sell your content or use it to advertise to you.

7. The Friends Feature

The Friends feature is optional. Friends can see each other's display name and scores, as described in our Privacy Policy. Scores are calculated by the app on your device and are for fun. We do not guarantee that another user's scores are accurate. You can decline any friend request and remove a friend at any time.

8. Not Medical Advice

Think Again is a brain-training and wellbeing tool. It is not a medical device, and it does not diagnose, treat, cure, or prevent any condition. Its games, scores, and statements about cognitive skills or screen time are general information, not medical, psychological, or other professional advice, and they are not a substitute for advice from a qualified professional. We do not promise that using Think Again will improve your memory, attention, focus, screen time, or wellbeing, or produce any other particular result. If you have concerns about your health, memory, attention, or phone use, please talk to a qualified professional.

9. Subscriptions and Payment

Think Again requires an active subscription to use.

• Purchases are made through the App Store. Subscriptions are sold and processed by Apple through the App Store. Your purchase is a transaction between you and Apple, and it is governed by Apple's terms as well as these Terms. We do not take payment directly, and we never see or store your payment card or bank details.
• Price and billing period. The price and billing period are shown in the app before you confirm your purchase. Prices may vary by country and may change over time. If the price of your subscription increases, Apple will tell you in advance and, where required, ask for your consent before renewing at the new price.
• Auto-renewal. Subscriptions renew automatically for the same period, at the then-current price, unless you cancel at least 24 hours before the end of the current period. Payment is charged to your Apple ID account at confirmation of purchase and again at each renewal.
• Free trials. Where a free trial is offered, it is described in the app before you subscribe. If you cancel at least 24 hours before the trial ends, you will not be charged. If you do not, the subscription begins and you are charged automatically. Any unused part of a trial is forfeited if you buy a subscription during it.
• Cancelling. You can cancel at any time in Settings → [your name] → Subscriptions on your iPhone. Cancellation takes effect at the end of the current billing period, and you keep access until then. Deleting the app does not cancel a subscription.
• Refunds. Because purchases are processed by Apple, refunds are handled only by Apple, at its discretion and under its policies. We cannot issue refunds for App Store purchases. You can request one at reportaproblem.apple.com. This does not affect any statutory cancellation or refund rights you have as a consumer that cannot be excluded by law.
• Restoring purchases. If you reinstall the app or move to a new device, use Restore Purchases in the app to restore an active subscription linked to your Apple ID.
• Deleting your account does not cancel your subscription. If you delete your Think Again account while a subscription is active, it will keep renewing and charging you until you cancel it in your iPhone's subscription settings.

10. Intellectual Property

The Service itself, including the Think Again name, branding, logo, design, games, software, and content we provide (but not your content), belongs to us and is protected by intellectual property laws. These Terms do not give you any right to use our branding or to copy or reuse the Service beyond using it as intended.

11. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains what data we collect, how we use it, who we share it with, and your rights. Please read it carefully.

12. Third-Party Services

Think Again relies on third-party services to operate, including Supabase, Render, Apple (Sign in with Apple and the App Store), Google (Sign in with Google), RevenueCat, and PostHog. Your use of features that involve these providers may also be subject to their own terms and policies. We are not responsible for third-party services, but we choose our providers carefully and describe them in our Privacy Policy.

13. Availability and Changes to the Service

We provide the Service on an "as available" basis. We may change, add, suspend, or remove features, or interrupt or discontinue the Service (in whole or in part), including for maintenance or development. We will try to give notice of significant changes where reasonable, but we cannot guarantee uninterrupted availability.

If the Service goes down or stops working properly, for example because of a bug or an outage at one of our providers, we will work to restore it as soon as reasonably possible. We are not liable for the time the Service is unavailable.

14. Termination

By you. You can stop using the Service at any time and delete your account in the app from Settings → Delete account. If you cannot use the app, email admin@tenzle.com from the address linked to your account. This removes your data as described in our Privacy Policy. Deleting your account does not cancel an active App Store subscription (see Section 9).

By us. We may suspend or terminate your access if you break these Terms, if we reasonably believe your use puts the Service or others at risk, or if we discontinue the Service. Where reasonable and lawful, we will try to give you notice.

When your access ends, your right to use the Service ends. Sections of these Terms that by their nature should survive (such as intellectual property, disclaimers, and limitation of liability) will continue to apply.

15. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure, that scores, streaks, or other figures shown in the app will always be accurate, or that the Service will produce any particular result for you.

Nothing in this section affects any rights you have as a consumer that cannot be excluded under applicable law.

16. Limitation of Liability

To the fullest extent permitted by law, we are not liable for:

• the Service being unavailable, interrupted, or slow, including during maintenance or because of an outage at one of our providers (such as Supabase, Render, Apple, or RevenueCat);
• errors in scores, streaks, levels, or other figures shown in the app;
• any result, or lack of result, from using the games or the calm timer (see Section 8);
• anything other users do, including the display names they choose and the scores they share; or
• any indirect, incidental, special, or consequential loss, or any loss of profits, revenue, or opportunity.

Permanent loss of your data. Apart from liability that the law does not allow us to exclude (see below), the only situation in which we accept liability is if a fault in the Service permanently loses or corrupts your account data, such as your progress, scores, or streaks, and it cannot be restored. In that case, our total liability to you is limited to the greater of (a) the total amount you paid for your Think Again subscription in the 12 months before the loss, and (b) GBP 50.

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited by law. If you are a consumer, you may have legal rights that these Terms do not affect.

17. Governing Law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales will have jurisdiction over any dispute. If you are a consumer living elsewhere, you may also benefit from any mandatory protections of the law of your country, and these Terms do not remove those protections.

18. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will tell you in the app or by email. The "Last updated" date at the top shows when these Terms were last revised. By continuing to use the Service after changes take effect, you accept the updated Terms.
